SMS Consent Documentation

This page documents how Gatsy collects opt-in consent from users for SMS messaging, in compliance with the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles and Best Practices, and Twilio A2P 10DLC requirements.

Gatsy operates a single Twilio 10DLC campaign that sends both transactional and promotional SMS messages to consented recipients only. This page describes the consent collection flow and provides publicly-accessible visual evidence of the consent UI.

How users opt in to Gatsy SMS

Users opt in during account registration at gatsy.net. The registration form has two steps.

Step 1 — Personal and company information

The user enters their first name, last name, email address, phone number (used for account support and recovery), company name, company initials, timezone, optional company address, and password. Microcopy beneath the phone number field reads verbatim:

Used for account support and recovery. SMS messages are sent only if you separately opt in on the next step.

The user must verify their email address via a one-time code before proceeding to Step 2.

Because Step 2 is reachable only after email verification, the screenshots in the “Visual evidence” section below document each stage of the flow — Step 1, the email verification screen, and the Step 2 consent UI — so the full consent journey can be independently verified.

Step 2 — Plan selection and SMS consent

The user selects a subscription tier (Basic, Pro, or Enterprise) and optional add-ons. Beneath the plan selection, three checkboxes appear, all unchecked by default:

  1. Transactional SMS consent (optional)
  2. Promotional SMS consent (optional)
  3. Terms of Service and Privacy Policy acceptance (required)

The user may complete signup with both SMS checkboxes left unchecked. SMS consent of either type is not required to create or maintain a Gatsy account.

Verbatim consent text

The two SMS consent checkboxes on Step 2 display the following text verbatim:

Promotional SMS checkbox

“By checking this box you agree to receive promotional SMS regarding sales and product updates from Gatsy. Msg frequency varies. Msg & data rates may apply. Reply HELP for help, STOP to opt out.”

The required Terms of Service and Privacy Policy acceptance checkbox sits directly beneath the two SMS checkboxes and links to https://gatsy.ai/terms-and-conditions and https://gatsy.ai/privacy-policy.

Visual evidence

After completing Step 1, the user receives a one-time verification code by email. Entering the correct code unlocks Step 2 where SMS consent is collected.

Consent logging and audit trail

For each SMS consent checkbox ticked, Gatsy logs a separate audit record containing:

  • Timestamp of the opt-in (UTC)
  • Consent type (transactional or promotional)
  • The exact consent text rendered to the user at opt-in
  • The source (signup or account settings)
  • The page URL where consent was given
  • The IP address of the device used
  • The browser's user-agent string

These records are retained for four years from the date of opt-out, or four years from the last message sent if no opt-out occurs.

Opt-out and help

Recipients may reply STOP to any Gatsy SMS to opt out. STOP is a global opt-out across all SMS categories — one STOP reply opts the user out of both transactional and promotional messages. The user receives one confirmation message and no further messages.

To opt back in, the user replies START or UNSTOP.

To request help, the user replies HELP or emails info@gatsy.ai.
